Agyeyev O. Constitutional and legal status of the ombudsman on migration: foreign models and prospects of introduction in Ukraine

The object of the dissertation research is social relations that reveal the content and peculiarities of the implementation of the constitutional and legal status of the ombudsman institution in Ukraine and foreign countries. The subject of the dissertation is the constitutional and legal status of the ombudsman on migration in foreign countries and the prospects for its introduction in Ukraine. Within the limits of the carried out research the formulations and the substantiated positions containing the scientific novelty are formulated and grounded. In particular: for the first time: - the definition of the concept of the ombudsman on migration is formulated, which should be understood as an independent, independent, personalized, depoliticized special institution of public-law oversight of state structures of different subordination in the field of implementing migration policy in terms of observance of the latest human rights of a migrant, introduced by parliament or with the consent of the latter, on the basis of a constitution or a unified or other special regulatory act, endowed with the relevant powers of recommendation and renewal MCUs specialized nature for the protection of migrants' rights; Improved: - Definition of the concept of human rights of a migrant as an object of constitutional and legal regulation, which is proposed to understand the international community recognized and approved and guaranteed by the state opportunities and claims of the migrant in the economic, social, political and cultural spheres of the host country for the use of elementary and most important benefits and conditions of safe, free and decent existence and development on the basis of the principles of equality and non-discrimination; got further development: - study of the norms of international law regulating the legal status of a migrant; - Definition of the concept of guarantees of human rights of a migrant; - defining the basic principles of the ombudsman's activities on migration.
