Essay

In the dissertation the author has improved theoretical provisions of criminal law concerning responsibility for actions that disrupt the work of penitentiary institutions, and scientifically substantiated proposals for improvement of art. 392 of the Criminal Code of Ukraine and practices of its application. A scientifically grounded definition of the notion of actions that disorganizes the work of the penitentiary institutions has been formulated as a punishment imposed by convicted persons in the form of deprivation or restraint of the will of bodily injuries, the threat of their infliction against convicts or the staff of the penitentiary institution in order to induce illegal activities, revenge for the execution of public or official duties, as well as the creation of an organized group for this purpose or active participation in it.
