Gavrylov Y. Banditry: Criminal Law and Qualification Problems

The dissertation is devoted to complex criminal-legal research of gangsters, solving a complex of theoretical and applied problems associated with this crime. The analysis of the current state of scientific development of the problem of criminal responsibility for gangsters in Ukraine is carried out. A detailed criminal-legal description of the legal composition of the crime provided for in art. 257 of the Criminal Code of Ukraine. The objective and subjective features of the crimes compiled in art. 187, 255, 257, 258-3, 260 of the Criminal Code of Ukraine. Author's definition of the concepts of "gang", "banditry", "public safety", "weapon" is offered. Characterized by such concepts as "participation in the gang" and "attack". The proposals on the improvement of the criminal legislation of Ukraine are substantiated.
