Volosko I. The jury trial in Ukraine: peculiarities of formation and functioning

The thesis is devoted to a comprehensive research of the theoretical and practical issues concerning the formation and functioning of the jury trial in the criminal proceedings in Ukraine. The legislation of Ukraine and foreign countries, the practice of domestic legislation’s application, the practice of the ECHR, scientific views of domestic and foreign scholars concerning the formation and functioning of the jury trial are analyzed in the thesis. The essence, procedure of formation, functioning’s peculiarities of the jury trial (in its various models) are researched. The elements of the juror’s defense during his activity connected with the administration of justice are elucidated. The procedure of the formation of jury lists in Ukraine and in different legal systems is considered. The procedural status of the juror and its realization during the trial are analyzed in the thesis. The author's vision of the jury trial’s model in Ukraine is formed. A number of suggestions and recommendations aimed at improving the legal regulation of the formation and functioning of jury trial in Ukraine are proposed.
