Essay

The thesis researches the electoral system of Ukraine as a constitutional-legal institution, studies the concept, features, and system elements of the electoral system. The existing scientific categories of definitions the electoral system was analyzed. The author studies the provisions of international instruments and sources of "soft law" in electoral engineering, researches criteria for designing of electoral systems. The conclusion was made that the content of the legal criterion for design of electoral systems and limits of constitutional control are confined by the principle of equal suffrage (active material, active formal, passive) and the principle of conformity of election results to the will of the people. Examines the doctrine of "political expediency" and electoral system as an object of constitutional control. The thesis performs characterization of an electoral district, electoral formula and the structure of a ballot as integrated elements of the electoral system. The author examines the genesis and prospects for improving the electoral engineering in Ukraine. The analysis is performed at the level of parliamentary, presidential and local elections.
