Essay

The dissertation contains theoretical generalizations aimed the solution of the scientific problem on the exploring the features of legal regulation of obligations arising out of unfair competition, in situations involving a conflict of laws, in private international law, as well as formulating suggestions and recommendations for the improvement of domestic legislation in this area. On the grounds of systematic analysis of the definitions of the concept of “unfair competition” existing in international treaties and Ukrainian legislation, underlined the following general features of this concept. Characterized the relations of protection against unfair competition in private international law of Ukraine, and determined their place in the system of private international law of Ukraine. Outlined characteristic features of the obligations arising out of unfair competition. Covered historical development of legal regulation of obligations arising out of unfair competition, in situations involving a conflict of laws, in European countries, as well as peculiarities of their legal regulation in the secondary law of the EU. Developed several scientifically grounded proposals on improvement of the legislation of Ukraine in the private domain of protection against unfair competition, in situations involving a conflict of laws.
