Menso I. Legal Regulation of the Activity of Electronic Libraries under the Civil Legislation of Ukraine.

The dissertation is the first special comprehensive study of theoretical and practical aspects of the activity of electronic libraries under the civil legislation of Ukraine. The legal principles of activity of electronic libraries according to the legislation of Ukraine and certain foreign countries are considered. The definition, features and types of electronic libraries are identified. The correlation between the concepts «electronic library», «database» and «Internet network» are researched. The types and forms of works in the electronic libraries are determined. The concepts of «living» works and «orphan» works were characterized. Digitization and digitalization are differentiated during the formation of electronic library collections and the order of their implementation is described. The correlation of the concepts of digitization of works and reproduction, taking into account international and European standards, is determined. The peculiarities of the free use of works by electronic libraries are revealed and contractual relations that arise during the process of functioning of electronic library collections are characterized. Scientifically substantiated proposals on the improvement of civil law regulation of relations that arise in the process of functioning of electronic libraries were formulated.
