Hnidan R. Lease contract of a land plot.

Thesis is devoted to research of actual theoretical and practical problems connected with the regulation of land lease agreements. In the work on the basis of the current legislation and practice of its application, the relations that arise during the conclusion, execution and termination of land lease agreements are analyzed, the concept and object of the contract is clarified.Particular attention is paid to the issues of the correlation of the norms of the Civil and Land Codes of Ukraine and other normative acts that regulate relations regarding land lease agreements, revealing inconsistencies and contradictions between them. The essential conditions of the lease agreement, the legal status of the parties of the contractual relationship, the liability of the parties for non-fulfillment or improper execution of land lease agreements are analyzed. The legal nature of the right to lease a land plot is investigated. It is concluded that the right to lease a land belongs to real rights, because in contrast to hiring (lease) of other types of property, the right to lease a land may be alienated.Considerable attention is paid to the development of proposals to improve the Law of Ukraine "On land lease".
