Essay

Dissertation is devoted to a complex criminal-legal characteristic of offences under Articles 191, 262, 308, 312, 313, 320, 357, 410 of the Criminal Code of Ukraine in case of their commission by abuse of authority. The work provides scientific description and explanation of social conditionality, bases and principles for criminalization of analyzed group of infringements, examines establishment of criminal liability for similar offences in EU countries. The dissertation provides characteristic of analyzed infringements as a group of corruption offences and ascertains their construction as composite corpora delicti. The work analyzes features of objects and subject matters of analyzed crimes, as well as means of their commission. The definition of interrelation between conducts in analyzed crimes has been furthered. It is presented as a combination the main conduct – illegal seizure – and subsidiary (additional) conduct – abuse of authority – as a mean of the main conduct. The dissertation works out propositions for enhancement of legislative definition of corruption offences and taking into consideration of the feature of committing offence by abuse of authority for criminal prosecution and punishment of a culprit.
