FYL R. Criminal Law Protection of the Rights to Industrial Property Objects in Ukraine.

Thesis is devoted to the complex study of a criminal law protection of rights to industrial property objects in Ukraine. On the basis of the analysis of doctrinal and normative sources, the content of industrial property as an object of criminal-legal protection in Ukraine and its main features are determined. Historical development of criminal law protection of rights to objects of industrial property on the territory of Ukraine is considered. The factors of an establishment of criminal law protection of rights to these objects in Ukraine are found out. The normative and legal principles of criminal law protection of the rights to industrial property objects in Ukraine are characterized. The content of crimes against the rights to industrial property objects in Ukraine is revealed, its author’s definition is formulated. The features of this type of crime are determined, in the aggregate presence of which this socially dangerous act can be qualified as a crime and structural elements of mentioned crimes are analyzed. Taking into account relevant international legal standards and foreign experience, several proposals for the improvement of the criminal legal protection of rights to industrial property objects in Ukraine are formulated.
