Essay

The work is devoted to the substantiation of the main provisions of the theory of research approaches as an element of the methodology of contemporary jurisprudence. The peculiarities of the process of formation of research approaches in modern jurisprudence, which belong to scientific problems are investigated, and are traditionally defined as methodological ones. They arise on the brink of various scientific disciplines and reflect integrative trends in the development of legal science. Objects that are studied with their help give you the opportunity to get new knowledge. Research approaches are different from the methods and try to give the investigated objects the way to scientific knowledge, determine the dynamics of the development of legal phenomena, the right of the scientist to choose the methodology. It is established that the methodological basis of the study is a pluralistic methodology, which combines research approaches, methods, as well as special legal methods and means of cognition. The components of the methodology are singled out, the first consists of specific means and methods of research, the second it is privately - a scientific method, represented by concepts and principles, the third is a world-view basis, ideological basis of research. The aspects of the research approach, namely conceptual, strategic, tactical and methodological, are revealed, and on the basis of this the author's concept of "research approach" in the broad sense is a complex of conceptual, tactical and methodological aspects. In the narrow sense, the term "research approach" applies to any aspect relevant to the practice of using this term in a scientific society.
