Maika N. Acquiring of proprietary interests in anybody’s real estate in civil law of Ukraine.

The dissertation investigates the order of occurrence of proprietary interests in anybody’s real estate in civil law of Ukraine. It is established that the emergence of proprietary interests in anybody’s real estate is carried out in practice in two ways: by establishing such rights and by acquiring. It is substantiated that in the basis of the emergence of proprietary interests in anybody’s real estate lies a legal composition that includes not only the direct basis for the emergence of proprietary interests (contract, testament, court decision, administrative act, etc.), but also such an important legal fact as state registration, which has law establishing character. According to the results of the study, a number of conclusions are presented that are characterized by scientific novelty and formulated proposals for the improvement of the current legislation.
