Humeha O. Realization of the civil legal principles in the course of intellectual property rights protection.

The thesis is the first monographic research purposed to define and to determine the peculiarity of the civil legal principles in the course of intellectual property rights protection. Thanks to the analysis of the legal relations existing in the sphere of civil legal protection of the intellectual property rights made through the examination of the law of Ukraine and different countries, of the doctrine, judicial practice, the author of the thesis offered the conception of determination of the role and the peculiarity of the realization of the civil legal principles in the intellectual property rights protection. The objective and the tasks of the research determined the choice of the structure of the thesis consisting of three sections and devoted to the overview of the civil legal principles, to the definition of the peculiarity of their realization in the sphere of the intellectual property, to the definition of the role and the peculiarity of the realization of the principle of the civil rights and interests protection in the course of intellectual property rights protection, to the analysis of the international legal aspects of stipulation of the private legal principles of the intellectual property rights protection and their realization in the national law and practice. The research contains the scientific and theoretical grounds as well as the practical recommendations to improve the protection of the intellectual property rights in the civil law in Ukraine. The concepts and the notions in the sphere under research were defined by the author more accurately. Thus, the concepts clarifications were offered to the Civil Code of Ukraine and special laws regulating the sphere of intellectual property.
