Andreychuk L. Legal protection of commercial names under the legislation of Ukraine and EU countries

The dissertation is devoted to the research of theoretical and applied problems related to the protection of rights to commercial names under the legislation of Ukraine and EU law. The main international legal documents and legislation of individual EU countries are researched and analyzed. The author's definition of a commercial name, its main features, principles of providing legal protection and functions in civilian circulation were formulated. The peculiarities of the use of commercial names in the digital environment, which at present have no proper legal basis, are researched. The types of violations of the rights to the commercial name and the corresponding methods of their protection are analyzed. Appropriate amendments, additions and clarifications to the current legislation are formulated in order to eliminate existing gaps, contradictions and incompleteness
