Essay

This dissertation is devoted to the study of human and citizen rights in the context of legal modernization. The treatise substantiates the proposals of the addition in the system of the human and citizen rights on the constitutional level with the following rights: the right to national self-identity; the right of a citizen to economic well-being; the right to access cultural property, contains the creation of a coordinating authorized body – the Public Council of Ukraine, whose powers will ensure the interaction of citizens with state bodies, ensure implementation and protection of their rights, the definition of the concepts of «human rights», «rights of a citizen», «human and citizen rights standards», «legal modernization», «civil, political, economic, social, cultural rights», «guarantees of human and citizen rights» are specified. The approach to differentiating of using the concepts of «personal rights», «individual rights», «physical rights» and the use of concept of «civil rights» in the theory of law is argued. The dissertation is proposed on the justification of a new direction – the humanization of the activities of state bodies through the strengthening with international elements in the mechanism of ensuring of human and citizen rights.
