Vanchuk I. The system of legal regulation of social relations: the theoretical and methodological aspect.

The thesis is devoted to the study of the theoretical and methodological foundations of the functioning of the system of legal regulation of social relations, the identification of its essential and specific features, as well as the formation of a qualitatively new approach to understanding the structural organization of this system. The author's periodization of the formation and development of the general theoretical construction of the system of legal regulation of social relations is proposed. Methodological approaches of general theoretical researches of legal regulation are analyzed and on this basis the technique of research of system of legal regulation of public relations is offered. It is proved that the legal regulation of social relations is characterized by such features, the presence of which, according to the theory of systems, gives grounds to identify it as a system and in the future to use such a scientific term as a system of legal regulation of social relations. The structure of the investigated system is singled out. The theoretical ideas on the formation of state policy in the sphere of legal regulation as the most effective means of functioning of the system of legal regulation of public relations have been expanded.
