Borysova K. Constitutional provision of the right to housing in Ukraine

This research is focused on the complex analysis of the constitutional principles of ensuring the right to housing in Ukraine, clarification of the features of the legal nature of the constitutional right to housing, the legislative consolidation of the right to housing at the national and international levels, and the studying of legal guarantees of the constitutional right to housing in Ukraine. On this basis, a number of scientific provisions, conclusions, proposals and recommendations for the legal protection of human rights and citizens in the aspect of the right to housing have been developed from the point of view of constitutional law. Different definitions of the concept of the constitutional right to housing in Ukraine have been analyzed and the actual author definition has been formed. The necessity of determining the list of persons who need social protection and its consolidation in the new Housing Code of Ukraine or a special law is substantiated. The question of the system of guarantees of the provision of constitutional law as a set of normative legal and organizational legal guarantees is disclosed. The problems of provision of the constitutional right to housing have been analyzed and the ways of improvement of legislation are proposed, namely: definition of concepts of state housing policy, affordable housing, components of adequate housing, necessity of adoption of the Law of Ukraine "On the Basic Principles of State Housing Policy" and the Law of Ukraine "On Providing of Affordable Housing in Ukraine "and so on.
