Druchek O. Administrative - legal status of the National Police of Ukraine as the subject of the child’s rights and freedoms provision

Qualification scientific work is devoted of researching of administrative and legal status of the National Police of Ukraine as a subject of child`s rights and freedoms provision. The historical and legal aspects of forming of the system of rights and freedoms of child are analyzed. The specified determinations of concepts «legal status of child», «right of child», «freedoms of child», «and interests of child» are offered. The description of concept of child`s rights and freedoms provision, its mechanisms, and its essence is exposed. The determination of concept of administrative and legal status of the National Police of Ukraine is offered and argued attributing to its structure of administrative norms and facilities: within the frame of the target bloc – the purpose, the aims, the principles of activity; within the borders of the organizational bloc – the structure of the National Police of Ukraine, its services and departments, their organizational subordination; the control over organization and activity; special procedures, forms and methods of activity; within the framework of the competitive bloc - tasks, functions, rights, duties and responsibilities of officials of the National Police of Ukraine in this area. The description of forms and methods of activity of the National Police of Ukraine in the field of child`s rights and freedoms provision is carried out. The understanding of preventive activity is offered in the environment of child as complex and system activity within the limits of the given plenary powers of subsections and services of the National Police of Ukraine, which is directed on an exposure, stopping and removal of reasons and terms of finance a child and persons, from its environment of crimes, offences, other types of deviants behavior, bringing in of guilty to responsibility, realization of positive influence with the purpose of diminishing of offences, the best providing and to defense of rights and freedoms of child. The foreign experience of organization of subjects of child`s rights and freedoms provision is generalized and determined conditions of its use in Ukraine. The basic directions of improvement of administrative and legal status of the National Police of Ukraine as a subject of child`s rights and freedoms provision is determined. The concrete suggestions of improvement of national legislation in a sphere activity of the National Police of Ukraine and department normatively legal acts on organization aspects and activity of Department of preventive activity of the National Police of Ukraine and service of juvenileуs prevention are given.
