Gumenyuk K. The Institution of Escheat of Property within the Civil Law of Ukraine

The thesis is devoted to a comprehensive research of scientific and practical problems of determining the place and clarification of the peculiarities of the Institute from the immortality of the inheritance in the civil law of Ukraine. Revealed the peculiarities of the transition of certain objects of civil rights to communal property as from the immovable property. Considered the genesis of the Institution of escheat of property in modern civil law of Ukraine. Formulated the concept and provided the characteristics of the Institute from the escheat of property. Found out the place of the institution of escheat of property in the system of civil law of Ukraine. Determined the legal relationship regarding adoption of escheat of property. Characterized by the performance of the duties of the successor in the escheat property. Disclosed features of the decree from the escheat property. Determined the procedure for recognition from the land plot. Clarified the process of establishing the status of escheat property in relation to the authorized capital. Considered the order of transition from the escheat property located in the temporarily occupied territory and territory of the operation of the Joint forces operation. Developed the proposals aimed at improving the legislation in the field of regulation of relations from the escheat property.
