Essay

The dissertation explains the nature of administrative legal status of public councils at executive power bodies. It determines that the status of the subject in the system of public administration, which is characterized by a set of certain rights, legal obligations, legal guarantees of implementation and legal responsibility, is regulated by administrative regulations. The structure of administrative and legal status of public councils at executive bodies include: rights and duties of public councils at executive power bodies; legal guarantees; legal liability. The author underlines and explains the nature of administrative legal status of public councils at executive power bodies. He formulated the set of research points about the legal nature of guarantees and principles of public councils at executive power bodies. It was proved that legal responsibility of public councils at executive bodies is a form of social responsibility, provided by the rules of law, and applies to public councils at executive bodies for failing to fulfill their established obligations or violating regulatory requirements, by unfavorable consequences in the form of personal constraints. The candidate argues that to ensure effective functioning of public councils system at executive power bodies, the following measures shall be taken: development and introduction of common standards and forms of cooperation between the public and public administration; development of nation-wide mechanisms for the functioning of public councils in executive bodies; systematization and generalization of decisions of public councils in executive bodies; regular analysis of the activities of public councils and their results for public discussion; introduction of standards for public reception, creation of a mechanism for interaction and implementation of the results of mobile groups through a system of public councils. Finally, the author studied the best international practices (France, USA, Federal Republic of Germany, UK, Spain, and other countries) in the area of creation and implementation of public policy. He also offered to implement those best practices in Ukrainian laws.
