Essay

In the thesis for the first time in the domestic legal science, the historical and legal aspects of the formation and functioning of Ukrainian scientific, public and cultural-educational institutions of Eastern Halychyna in the second half of the XIX – first half of the XX century were investigated. The main layer of materials related to the analysis of the subject of the dissertation research is in the funds of the Central State Historical Archive in Lviv, the State Archive of Lviv Region, the State Archive of the Ternopil Region and the State Archive of Ivano-Frankivsk Region. Texts of charters, regulations, circulars, reports on activities, minutes of meetings of the General Meeting and a number of other structural links were introduced for the first time in scientific circulation, as well as other organizational and administrative documentation of public, scientific and cultural-educational institutions of Eastern Halycyna in the middle of the ХІХ – first half of the ХХ century. The methodological basis of the research is a set of methods and approaches, among which we single out: dialectical method, historical method, heuristic method, comparative and legal method, dogmatic and legal method, formal and logical method, axiological method, formal and legal method, hermeneutic method, system approach, institutional approach, the analogy and extrapolation. The first chapter of the dissertation describes the prerequisites for the formation and functioning of Ukrainian scientific, public and cultural-educational institutions of Eastern Halychyna in the second half of the XIX – first half of the XX century. From the second half of the ХІХ century, a number of Ukrainian public associations emerged in the Austrian Empire, which set the task of developing science, culture, education and schooling, cooperation, and charity. The legal basis for their activities was the current Austrian legislation, and in particular the Civil Code, which was one of the first legal acts in Europe, consolidated the legal status of public institutions on the territory of the monarchy. It was found that the structure of public and other organizations, societies and unions, the current Austrian, Ukrainian and Polish legislation in the middle of the XIX – first half of the ХХ century treated approximately the same. The statutes of organizations were mostly unified and reflected in their text: the name, purpose and objectives of the activity; indication of the place of disposition; the composition of the partnership, as well as the rights and obligations of members; ways of formation and functions of management bodies of organizations, societies and unions; peculiarities of establishment and activity of branches, circles and sections of the company, their jurisdiction, as well as the powers of their governing bodies; the peculiarities of the work of the control commission, which exercised control and oversight functions for all types of activity that was stipulated by the charter; legal component of dispute resolution; external representation of the company in relations with the current government and other political and public organizations; time, method and legal components of the liquidation of the company. It is proved that the formation and functioning of the cultural-educational societies of Eastern Halychyna in the second half of the XIX century and the first half of the XX century was aimed at the formation of the national and cultural consciousness of the Ukrainian people, as well as the provision of cultural and educational needs through the prism of national-patriotic upbringing. The administrative and legal structure of cultural and educational institutions was built in such a way as to ensure the maximum effect on the solution of cultural and educational problems of the Ukrainian population.
