Fesenko Y. Distinctions of inheritance of copyrights.

The thesis is devoted to the consideration of the legal relationships in the matter of inheritance of copyrights, to analys is of legal status of different subjects of the hereditary legal relationships in the context of succession of copyrights law. The paper deals with the researching of problems of supplying, preservation and defense of rights authors’ lawful heirs. The analysis is centered around the legal basis of devolution of exclusive rights on work in succession by inheritance, legislative and doctrine approaches of the distinctions of succession. The thesis focuses on the investigation of the new subjects of copyright law. The distinctions of heir’s copyrights legal status have been determinated. Special aspects of legal nature of other subjects, which take part in the relationship, connected with the inheritance of copyrights have been considered. Moreover, the legal authorities, concerning these rights have been explored. The problems of supplying, preservation and defense of rights of author’s personal non-property and property copyrights have been examined. Based on the results of the study, series of references have been formulated to improve current legislation of Ukraine and its practical application.
