Melnyk A. The quality of the law: theoretical, methodological, technical and legal aspects

The thesis summarizes scientific and theoretical views on the quality of the law in the history of the world and domestic legal thinking. The author singles out three approaches to the development of scientific knowledge and views on the identified legal problem: philosophical, sociological and juridical. Peculiarities, importance, criteria and aspects of the quality of the law are revealed. The author figures out the nature, essence and functionality of the legislative technique as a tool for drafting qualitative laws as well as the influence it has on the quality of the law. The author’s understanding of the quality of the law in the technical and legal aspects is revealed. The thesis singles out the following technical and legal criteria for the quality of the law: legal and linguistic; legal and logical, a criterion of the quality of internal structure, a criterion of compliance with the law’s layout. The author identifies linguistic errors in legislative texts wording and justifies the ways of their elimination.
