Chornukha O. Legal Support of Fair Competition in Ukraine

The dissertation is devoted to the legal analysis of the competitions which contradict trade and other fair traditions of economic activity guaranteed by articles 229, 231 and 232 of the Criminal Code of Ukraine. It also deals with the grounds and methods of differentiation of criminal liability for unfair competition as well as the problems of identification of counterfeit objects. The content of relations between economic entities that take part in unfair competition has been studied and its value in the process of protection of public, competitors and consumers’ interests as priority to be protected from unfair competition has also been analyzed. Foreign experience of legal protection of competitive relations has been studied. Faults and drawbacks of identification of criminal liability for breaking relations between economic entities because of unfair competition have been assessed. A new redaction of articles 229, 231 and 232 of the Criminal Code of Ukraine has been offered. The content of articles 305 and 321-1 of the Criminal Code of Ukraine which deal with counterfeited medicines as an object of crime has been completed by the remark about their danger for life and health of a person.
