Astahovа A. Crime Situation under the Criminal Law of Ukraine.

In terms of its character and the content of the researched matters, this manuscript is the first complex and systematic Ukrainian work devoted to the research of a crime situation under the criminal law of Ukraine. In this dissertation, a series of conclusions, theoretical provisions, and suggestions which have features of the scientific novelty are formulated or additionally proved. During the research, the backgrounds and genesis of a crime situation under the Criminal Code of Ukraine are defined. The definition of an idea of “a crime situation” is formulated. The criminal-legal category of “a crime situation” and its correlation with other ideas of criminal law is investigated. The analysis of the criminal-legal forms and kinds of the expression of a crime situation in the current criminal law of Ukraine is provided. The research of the current legislation regarding criminal responsibility for crimes in the active combat sphere and other situations of battle conditions as well as the way for its improvement is made. The definition of a crime situation in the active combat zone is given; its forms and kinds are defined; the circumstances that characterize the crime situation in the system of grounds for relief from criminal responsibility are uncovered. The suggestion regarding novels and amendments to the Criminal Code of Ukraine are developed.
