Masyk M. Organizational and legal mechanism of public-private partnership in the housing and communal sphere of Ukraine

The dissertation solves the actual scientific task, which consists in theoretical and methodological substantiation of the peculiarities of the application of the organizational and legal mechanism of public-private partnership in the housing and communal sphere of Ukraine and the development of practical recommendations for improving the activity of the authorities in this area. The proposed economic and public management approaches to the definition of public-private partnership in the housing and communal sphere. The economic approach involves the redistribution of powers between the state and business in order to attract investments in the field not subject to privatization, but for which the state does not have the means for development, and public-management - a form of rationalization of the state's fulfillment of its responsibilities to society in providing quality services through cooperation with business. The application of perspective forms of public-private partnership in the housing and communal sphere of Ukraine, including: service contracts; management contracts; leasing; joint venture; BOT contracts; DBOF contracts that will promote the improvement and development of housing and communal infrastructure and provide high-quality housing and communal services to the population. The definition of the category of public-private partnership in the housing and communal sphere as a legally-formative system of economic relations reflecting the mutually beneficial interaction between the state and private sector entities for the purpose of profitable use of it through minimization of operational risks and the effective use of all available resources for satisfaction is proposed. social needs, in which socially significant projects or measures using state property are implemented, based on the division between the parties in full risks, financial costs and responsibilities, in order to increase the effectiveness of the state's performance of its functions, which is carried out on the basis of the agreement, the subject of which is the restoration of the infrastructure of housing and communal services. The regulatory and legal mechanism of public-private partnership in the housing and communal sphere has been improved, which provides for amendments to the Law of Ukraine "On Public-Private Partnership" regarding the procedure for identifying a private partner; to the Tax Code for the introduction of preferential tax treatment for a private partner. The organizational mechanism of public-private partnership in the housing and communal sphere has been improved through: creation of regional public-private partnership institutions that will address the problems of infrastructure development within the framework of inter-municipal cooperation; introduction of unified procedures for all types of public-private partnership contracts; introduction of a transparent competitive procedure for selection of private partners in the PPP projects by creating an independent electronic public platform.
