Herbut V. The right to sexual orientation and gender identity: the essential content and guarantees of protection

The dissertation is devoted to the constitutional and legal analysis of the right to sexual orientation and gender identity, its essential content and guarantees of protection. There was made a comprehensive study of modern trends in understanding of this human right as a separate category, as well as in relation to human dignity, the principles of equality, non-discrimination and together with the right to private and family life; the features of the case law, concerning protection of the right to sexual orientation and gender identity are also considered. On this basis, a number of scientific provisions and conclusions regarding the essence, features and legal protection guarantees of the right to sexual orientation and gender identity were developed, as well as number of suggestions and recommendations were offered, aiming to improve domestic legal and regulatory frameworks in order to expand legal and formal content of the human right studied, and to increase the effectiveness of its judicial protection in practice.
