Dmytrenko V. Execution of mortgage obligations under civil legislation of Ukraine

The dissertation is devoted to the study of the execution of the mortgage obligation under the civil law of Ukraine. The genesis of the mortgage institute in the aspect of execution of the mortgage obligation in different periods of formation and development of this institute are revealed. The patterns of formation and development of legislation on mortgages in Ukraine for certain periods are revealed. The evolution of civilized thought in relation to the implementation of the mortgage obligation and related issues of mortgage, mortgage legal relations, obligations and its implementation. The peculiarities of the application of the system of general scientific and special methods in the study of the implementation of the mortgage obligation are separately identified. Formulated author's approach to understanding of the executiont of the mortgage as a component of the mortgage institution by defining the content and features of the mortgage and clarifying the provisions on the execution of the obligation. The general conditions of mortgage obligation execution are defined and its specificity is disclosed. The peculiarities of protection of civil rights and interests of subjects of execution of a mortgage obligation are considered. The ways of improvement of certain provisions of civil legislation of Ukraine in the analyzed sphere are offered.
