Mazur V. Mechanism of civil regulation of easement relations in Ukraine

It addresses the issue of formation and development of the theory of the mechanism of civil regulation, its position at the present stage of scientific research in legal matter, the main provisions which are the basis for the corresponding theory and which determine the strategy for the research of the mechanisms of civil regulation of any type of civil relations, including easement relations. The theoretical and methodological approaches to understanding the essence of the mechanism of civil regulation existing in legal doctrine in general and civil law doctrine in particular and the actual results of their application in civil law were analyzed. The criticisms available in the legal literature concerning the appropriateness of using the category of «mechanism of civil regulation» in legal science have been considered; and it has been concluded that they were premature.
