Vakarova O. Constitutional and legal status of law enforcement bodies: modern approaches

The dissertation is devoted to the comprehensive study of the constitutional and legal status of law enforcement agencies in Ukraine, also reveals theoretical and methodological and scientific and practical aspects of the mentioned problem. It is analyzed theoretical principles of the constitutional and legal status of law enforcement bodies by the critical analysis of key concepts of this sphere. It is noted that today the scientific doctrine does not contain a single approach to the definition of "law enforcement bodies" and their constitutional and legal status. In addition, the study of related concepts such as "law enforcement function", "law enforcement activity", "law enforcement system" confirms the lack of consistency in the positions of scientists in understanding these terms. It is characterized the constitutional and legal status of the Specialized Anti-Corruption Prosecutor of Ukraine, its main functions, tasks and procedure of interaction in the system of anti-corruption bodies of Ukraine are defined. Proposals on the improvement of the legislation regulating this body of state power are formulated, in particular the bringing of the functions of the SAP, enshrined in the Law of Ukraine "On the Prosecutor's Office" to the provisions of the Basic Law; resolving conflicts of authority in the field of international cooperation between the Prosecutor General's Office and the Specialized Anti-Corruption Prosecutor's Office.
