Semenyuk N. Time of the Commission of the Crime under the Criminal Law of Ukraine (doctrinal, legislative and practical aspects)

In terms of its character and the content of the researched matters, this manuscript is the first complex and systematic Ukrainian work devoted to the research of the time of the commission of the crime under the criminal law of Ukraine. Basing on the research the scientifically grounded suggestions regarding the improvement of the current legislation are formulated. In this dissertation, a series of conclusions, theoretical provisions, and suggestions which have features of the scientific novelty are formulated or additionally proved. During the research, the backgrounds and genesis of the time of the commission of the crime as an element of an actus reus under the Criminal Code of Ukraine are defined. The series of the present criminal-legal meanings of the time of the commission of the crime is developed. The author gives substance and defines the time of the commission of the continuing crimes, continual crimes, and jointly committed crimes. The dissertator researches time as the factor of the criminal-legal assessment of the committed crime. The author defines the role of the time as the factor of the implementation of the means of the criminal-legal influence. The suggestions for the improvement of the current legislation regarding the definition of the time of the commission of the crime are developed.
