Essay

The thesis is the first Ukrainian monographic research for criminal liability for violation of rules, regulations and standards relating to road-traffic Safety. The paper analyses theoretical aspects of the object and subject matter of crimes, provides their definitions with regard to elements of a crime as stipulated by Art. 288 of the Criminal Code of Ukraine. The paper also gives the grounds for distinction between this crime and allied elements of crimes and similar administrative delict. The work defines the generic object, direct object and subject matter of this crime. There is determined that criminal law provides for the grounds for and conditions of release of a person from punishment that is illustrative of its humanism and justice. In view of this, penalty doesn’t mean an automatic punishment of any and all guilty persons, inasmuch as criminal law permits to punish only through less severe sanctions unrelated to social isolation of a person, and to proceed to more severe sanctions providing for certain terms of imprisonment.
