Zahrebelna N. Theoretical and methodological principles of prosecutorial rhetoric as a component of the theory of state and law

In the dissertation are outlined the results of theoretical and law research, that has fundamental nature and concerns to studying theoretical and methodological principles of prosecutorial rhetoric as an integral part of the theory of state and law, common provisions of professional prosecutor's practice and realization of tasks and functions of the procuracy. Detailed scientific consideration in the dissertation task dues to theoretical and methodological principles of prosecutorial rhetoric as a component of the theory of state and law, also was analyzed the connection with general philosophy, and other law and special-law sciences, namely - with criminal-procedural, civil-procedural and economic procedural law. Within the framework of the dissertation is substantiated by legislative ensuring of the status of procuracy, its official persons, order and forms of the implementation functions and tasks of the procuracy, individual species of the professional activities of prosecutors workers, as well as legal relationship in the implementation of the prosecutor laid by legislation to official authority, in particular application in practice of prosecutorial rhetoric. Important part of thesis research is about theoretical and methodological and law bonds of the prosecutorial rhetoric with the theory of state and law as its’ component, with the philosophy of law, special-law sciences, that are researched at the level of principles of organization at branches of law, organizational and legal forms of professional communications of the prosecutor in various spheres and with taking into account application of rhetorical funds and receptions in prosecutorial rhetoric. Considering the importance of the ethical aspect of the prosecutors' practice in modern realities of development in Ukrainian society, in this work were explored the moral and ethical quality of prosecutors workers, their abilities and skills of professional prosecution rhetoric combined with the methodology of the educational process, psychological preparation, improvement of rhetorical skills.
