Kravtsiv Y. Food Products as Objects of Civil Rights

In the paper for the first time in the domestic civilised science on the basis of a holistic analysis of the doctrine of objects of civil rights and positive law is held the positivist conception of the latter as things and benefits, are formed doctrinal provisions and proposals for the improvement of acts of civil and special legislation. The paper reveals manifestations of problems and states the need to strengthen the legal regulation of relations concerning food products; establishes their features as objects of civil rights and proposes to provide them in the Civil Code of Ukraine; establishes their legal regime; it is proved that the right to food products is an independent right and part of other rights; determines basic relations concerning them and the European and national practices of their positive regulation, including those that are created as objects of intellectual property rights; establishes the basic grounds for the emergence, implementation and termination of rights to them; reveals basic violations of rights and their consequences, in particular civil liability; forms proposals to the current legislation.
