Averianova Y. Legal regulation of licensing of economic activity

The paper proposes the improvement of the concept of "licensing of economic activity". The features of licensing of economic activity. The provisions concerning the branch affiliation of the institute for the licensing of economic activities have been improved. It is proposed to consolidate in the Law on licensing such a sanction as the suspension of the license. The introduction into the licensing system is substantiated: the principle of tacit consent; limitation of automatic succession at the time of license renewal; the ability to operate without obtaining a license exclusively for the approval of the relevant license terms. The rules of law concerning the procedure of licensing of foreign economic activity and provision of financial services have been improved. The expediency of supplementing the list of administrative offenses, for which the persons responsible in accordance with the disciplinary statutes with respect to the violation of the legislation on licensing of economic activity, is substantiated. It is proposed from the positions to be implemented within the framework of adaptation of national legislation to the EU legislation, to exclude the need for licensing of postal services, to implement the general European requirements for insurance companies without switching to licensing insurance classes instead of licensing the type of insurance activity.
