Essay

The thesis is an independent, completed scientific work devoted to a complex theoretical and applied research of the legal regulation of legal relations arising in the process of providing evidence in the civil process of Ukraine. In the dissertation work, the emergence and development of the institution of providing evidence in the civil process of Ukraine was investigated, and as a result, it was revealed that a substantial influence on the foundations, limits and initiation procedure (including the initiating subject), providing evidence at each stage of the development of legislation, was implemented by a social structure model which predetermined the peculiarities of the judicial process. The study of the place and role of providing evidence in the process of evidence showed the accompanying nature of the institution in relation to the process of proving and collecting evidence. Based on the basic principles of the civil process, it serves as a means of securing evidence for its further use in the judicial process, from a procedural point of view, and is the right of the person concerned to assist him in collecting and fixing evidence, from a material point of view.
