Essay

The research dedicated to analyses of the right to peaceful assembly, in particular, its origin and development from the moral category to subjective right. The author reveals the characteristic features of the peaceful assembly as a legal category and also the issue of the correlation of this right with related rights, as well as the place of right to peaceful assembly in the system of human rights. The author also summarizes the case law of European Court of Human Rights dedicated to the freedom of peaceful assembly, examines the challenges of national legislation and judicial practice and offers ways of improvement of national regulation in order to resolve current problems in legislation and practice. The scientific novelty of the results of the study is based on the aggregate of the data on the object of research, and also allows to solve topical issues in the field of protection of freedom of peaceful gatherings in Ukraine.
