Sukhodolska A. Implementation of the Right for Free Movement: Theoretical and Legal Basics.

An interdisciplinary approach has been applied with the use of legal, political and economic sciences and public administration science in order to study current trends of provision the right for freedom of movement. The statement is based on the idea of the mutual market as the foundation of the European Union formation without restrictions and discriminations and the principle of free movement, known as the "four freedoms", which include the rights for freedom of movement of labour, capital, goods and services. These freedoms are based on the international guarantees of rights and freedoms developed by the UN, the Council of Europe, the OSCE and other authoritative organizations. It is proved that as theoretical and legal category and principle of right the freedom of economic activities in the EU is ensured by the abolition discriminatory provisions and restrictive practices concerning the produces, buyers and consumers, inner taxes and donations, subsidiaries and assistance from national governments. The essence of the concept of freedom of moving of services and legal adjusting of competition is analyzed, necessity for Ukraine for an output in the sphere of grant of services on territory of European Union of harmonization of legislative and in the institutional changes with the purpose of introduction of standards of EU in political and legal and socio-economic practice. On the basis of theoretical and legal research is offered changes to the legislation in relation to the improvement of legal guarantees on freedom of moving, and also the row of suggestions is brought in in relation to the institutionally implementation of realization in Ukraine of «four freedoms» of EU which will assist development of democracy in our state.
