Mostovenko O. Realization of the Right to Medical Care: Civil and Legal Aspects

Annotation content. The thesis analyzes the civil law aspects of realization of the right to medical care. In the paper, the scientific novelty of the obtained results is formed, which consists in the fact that the thesis is a special complex research in which the forms of realization of the right to medical care were first analyzed. A critical analysis of the implementation of the right to medical care is carried out, namely through a network of state and municipal health care facilities, through private health care facilities and the health insurance system. The conclusion is based on the fact that medical care is provided in the form of a medical service, by contacting the patient with a health care establishment or an individual entrepreneur who carries out medical activities. Such a service is always paid by its customer, which may be the state, local self-government bodies, legal and natural persons. The analysis of getting medical care in state and communal health care institutions is carried out in the compliance with the branch affiliation.
