Essay

The object of research is the social relations that arise in the process of legal regulation, the formation and development of staffing of forensic expert institutions of Ukraine. Purpose: to determine the essence, content and features of the administrative and legal principles of personnel provision of forensic expert institutions of Ukraine, ways of their improvement taking into account domestic practice and foreign experience. Methods: general and special methods of cognition, in particular, dialectical, logical-semantic, historical-comparative and historical-legal, legal, analytical, etc. Theoretical and practical results, scientific novelty: a comprehensive analysis of the process of formation and development of personnel provision of forensic expert activity in Ukraine was conducted, resulting in nine stages; scientifically substantiated and developed a comprehensive description of the system of subjects of staffing of forensic expert institutions of Ukraine: 1) horizontally: Ministry of Justice of Ukraine - Ministry of Internal Affairs of Ukraine - Ministry of Health of Ukraine - Ministry of Defense of Ukraine - Security Service of Ukraine; 2) vertically - according to the levels of structural subdivisions of forensic expert institutions of Ukraine (expert institutions of the Ministry of Internal Affairs, for the fulfillment of which the Expert Service of the Ministry of Internal Affairs of Ukraine was established; higher educational institutions and other special institutions of the respective ministries and other central executive bodies); It was suggested for the judicial-expert institutions of different departments to develop united: 1) Integrated program of work with personnel of forensic expert institutions of Ukraine (approved by the Cabinet of Ministers of Ukraine); 2) a typical educational training program for the forensic expert institutions of Ukraine, specializing in "Forensic examination"; 3) a typical training program for advanced training of forensic experts (in particular, heads of forensic institutions); 4) differentiated test tasks for the purpose of verifying the professional training of forensic experts; formulated requirements that should be envisaged in the Integrated Program of Work with Personnel of Forensic Expert Institutions of Ukraine: 1) knowledge of normative legal acts regulating forensic expert and scientific activity; 2) knowledge of methodologies and special literature on conducting expert research in the corresponding direction; 3) knowledge of norms on occupational safety and safety, fire safety and rules of internal labor regulations; 4) personal qualities and abilities: logical thinking, observation, attention, responsibility, emotional stability; 5) knowledge of the professional ethics of the court expert; 6) observance of the oath of a judicial expert; the expediency of optimization of the criteria for assessing the quality of personnel of judicial-expert institutions of Ukraine is substantiated, giving preference to qualitative indicators and parameters over quantitative ones; it is proposed to resolve the issues of assessing the staffing of forensic institutions and determine the system of criteria for such evaluation by adopting the Resolution of the Cabinet of Ministers of Ukraine "On Approval of the Procedure for Evaluation of the Quality of Activities of Forensic Institutions". Practical significance: the obtained results can be used in the field of research as a basis for further development of the problems of staffing of forensic expert institutions of Ukraine; law-making, in the course of making amendments and additions to the normative legal acts regulating staffing of forensic expert institutions of Ukraine; law enforcement activities in order to improve the practical activity of forensic expert institutions of Ukraine. Field of use: in the educational process during the preparation of lecture materials, textbooks and training manuals on disciplines "Administrative law", "Administrative process", "Public administration" and other disciplines of an administrative-legal nature, during preparation of their respective sections.
