The research is dedicated to theoretical justification of the essence, content, and particularities of forming a mechanism of public management of risks in the facilities construction and operation fields through using a technical regulation system, identifying innovative approaches and hands-on recommendations for improving the system of technical regulation in construction in Ukraine.
The work discovers that the society is combating the threats identified as risks in the economy, politics, ecology, and social are, which directly affect the state’s existence and destabilize socio-economic life. The experience of building and operating facilities drives to a conclusion that it is necessary to identify the risks and minimize their possible negative effects as early as the stage of engineering surveys, selection of structural materials, and adopting design solutions.
The research results show that at present public administration in the field of facilities construction and operation is characterized by an unsystematized nature, the regulating system is unbalanced and does not make use of risk-oriented mechanisms to manage the field.
For the first time the thesis suggests a new model of public risk management in the field of facilities construction and operation in the system of construction technical regulation and provides recommendations for giving a key role to a collegial self-regulated body a legal public law entity – Commission for Technical Regulation of Construction.
The work improves approaches to the governmental policy of creating a safe and comfortable living environment for human activities, risk prevention, mitigating and remedying consequences of the risks’ influence by spreading the basic requirements to facilities as identified risks not only at the construction stage but also at all stages of the facility’s «life cycle».
New scholarly views are suggested as per Ukraine’s possible adaptation of foreign experience in establishing a risk-oriented regulation system characterized by singling out key priorities of such adaptation.
The work develops a mechanism of public management of risks in construction with technical regulation means through setting up a hierarchal dependence of the public administration level and requirements ranging.
The author suggests their own definition of the concepts: «risk in construction», «technical regulation in construction», «parametrical way to form requirements», «administrative way to form requirements», «target way to form requirements», «justified operational period of a facility».
The thesis proposes to set as priority adopting technical solutions ensuring compliance with basic safety requirements by a responsible officer (designer and/or expert).
The work arranges the basic components and difficult elements of the system of public management of risks in construction and operation of facilities, which includes main clusters distribution by the level of requirements setting and supervision of compliance with the same.
The author justifies approaches to regulatory support in the field of facilities construction and operation and articulates ways to improve public management of risks with such technical regulation means as: spreading general technical regulation principles and technical regulation requirements onto the final construction product (facility); establishing a public risk management system, and regulatory legalization of risk prevention mechanisms.
