Bieltiukova Y. Legal regulation of the continuity of property rights of intellectual property under the civil legislation of Ukraine.

"Dissertation is for the first time conducted in the national science of civil law with a special complex investigation of the continuation of property rights of intellectual property under the civil law of Ukraine. The main characteristics of the continuation of property rights of intellectual property are analyzed. Author investigate of scientific positions and legislative norms concerning the concept and types of continuity of property rights, as well as procedures and extent of continuity of property rights by various subjects. Particular attention is paid to the contractual form of continuation of proprietary rights of intellectual property. The main advantages of contractual form of succession are highlighted. The main features and conditions of the license agreement and the license, the contract on the creation of the order and use of the object of intellectual property rights, the agreement on the transfer of exclusive proprietary rights of intellectual property are investigated. The features of the inheritance of property rights by law and by will are determined. The order of inheritance of property rights of intellectual property objects in the presence of several owners and such an object is determined. The continuity of property rights in the reorganization of legal entities has been analyzed. Author investigate established procedure for foreclosure of property rights of intellectual property. In the process of investigation various aspects of the chosen problem, special attention was drawn to judicial practice. Formulated conclusions on the improvement of Ukrainian legislation in the field of regulation of the continuation of property rights of intellectual property."
