Panova S. Monuments of architecture as an object of civil rights.

The dissertation is the first in the science of civil law of Ukraine for a special comprehensive study of the civil law regime of monuments of architecture as an object of civil rights. The dissertation discovers the concept of objects of cultural heritage and their classification is carried out. The subjects of property rights for objects of cultural heritage, in particular monuments of architecture, have been identified and characterized. The notion of monuments of architecture is formulated and their classification is made. The peculiarities of acquisition, implementation and termination of ownership of monuments of architecture are revealed. Restrictions on ownership of architectural monuments are considered. The legal nature of the guard contract is determined and the civil law consequences of its violation are described. The problematic issues that arise during the court consideration of disputes related to architectural monuments are considered, and the theoretically substantiated proposals concerning their prevention are provided. Proposals on improvement of the current civil law of Ukraine concerning the legal regime of monuments of architecture as objects of civil rights are formulated.
