Pidcenko U. Court decisions in cases of special proceedings

The dissertation is a complex scientific research of the institute of court decisions in cases of special proceedings. The analysis of the state of scientific development of the problem of court decisions in cases of special proceedings, the methodology of carrying out of the corresponding research, and also the evolution of the legal regulation of the institute of court decisions in cases of special proceedings are traced. The concept is formulated and types of court decisions in cases of special proceedings are singled out. The procedure for the adoption, proclamation and enactment of court decisions in cases of special proceedings is analyzed, ways of correcting deficiencies in such court decisions are determined. The features of court decisions adopted in certain categories of cases of special proceedings are singled out. On the basis of the analysis of the scientific doctrine and the current civil procedural legislation of Ukraine, proposals were made to improve certain legal norms.
