Tanadzhi V. Criminal-legal Protection of the Rights of Employees in Contractual Relationship with Employer (Art. 173 of the Criminal Code of Ukraine)

The dissertation is devoted to the research of peculiarities of criminal legal protection of right of the employee in contractual relationship with employer. The work analyses historical-legal aspects ofemergence criminalliability for gross violation of an employment contract (art. 173of the Criminal Code of Ukraine), studies foreign experience regarding this question, namely criminal legislature of such countries as the USA, France, Poland, Japan and legislation of post-soviet countries, which in any form contain norms on criminal liability for violating labour rights of a person in contractual relationship with employer. The dissertation ascertains main notions of the analysed crime, proposes criminal-legal characteristic of its objective and subjective features. The work proposes ways of enhancement of art. 173of the Criminal Code of Ukraine, for instance introducing amendments to its disposition and supplementing this article with a note. The dissertation ascertains peculiarities and criteria of delimitation of corpus delicti of crime provided by art. 173of the Criminal Code of Ukraine, from other crimes, including articles 149, 190 of the Criminal Code of Ukraine. The work examines sanctions of art. 173of the Criminal Code of Ukraine.
