Essay

The dissertation researched the constitutional right to free professional legal assistance. The paper analyzes the doctrinal approaches to the meaning, essence and legal nature of the right to free professional legal assistance. The determinants of the legal regulation of the right to free professional legal assistance are formulated. On the basis of the analysis is the definition of the right to free professional legal assistance in the constitutional law of Ukraine. Attention is paid to the content and subjects of the constitutional right to free professional legal assistance in Ukraine. A specific feature of the constitutional right to free professional legal assistance is also that sources of such right, in addition to the Constitution, must be required by other acts of legislation. The history of formation and foreign experience of development of the constitutional right to free professional legal aid are established and analyzed. The necessity of developing proposals on improving the mechanism for the implementation by individual categories of citizens of their constitutional right to free professional legal assistance is substantiated. People’s right to free professional legal assistance has undergone significant stages of its formation and transformation. The civilizational development of society determined the level of social orientation of the state, and in particular the political power of the time.
