Boiko Y. Criminal and Legal Protection of Patient’s Rights in Ukraine

The dissertation is devoted to the complex research of the criminal and legal protection of patient’s rights in Ukraine. The historical development of the criminal and legal protection of patient’s rights in Ukraine is considered. The experience of foreign countries in ensuring the protection of patients’ rights is studied, the implementation of international legal standards in domestic legislation is proposed. On the basis of the analysis of legal sources, the state of legal regulation of ensuring the implementation of the criminal and legal protection of patient’s rights in Ukraine is revealed. Inadequate performance of the duties of a healthcare professional or their non-fulfillment is described as a basis for taking criminal responsibility measures for violation of the patient’s rights. Violations of the mode of access to the patient’s health information as a basis for the application of criminal liability for violation of the patient’s rights have been investigated. The characteristic of violation of standards of carrying out of medical-biological experiment as a basis of application of criminal responsibility for violation of rights of the patient is carried out.
