Essay

For the first time in the theory of intellectual property law a comprehensive analysis of a theatrical production as an intellectual property item was made in the thesis paper, which made it possible to identify the shortcomings of the legal regulation of the legal regime for the protection of this item. The paper analyzes the components of a theatrical production – the objects of copyright and related rights, through which the theatrical production acquires a regime of “complex” object. The features of a theatrical production as an object of law have been elucidated, and the generally recognized features of a copyright object have been identified: the creative nature and the objective form of expression manifested in the availability of performers, play acting, etc. In addition, a set of features, which are specific features of the theatrical production and which are of obligatory or optional nature, which determine the differences between this object and others, are identified. The grounds for the classification of theatrical productions by the content, by the form of the actor's performance, by the number of performers involved, by the professional level of performers, by the localization of performance, by the way of demonstration were analyzed, and the peculiarities of the legal regime of protection of certain types of theatrical productions were elucidated.
