Kviatkivskyi Y. Criminal enforcement characteristics of execution of punishment in the temporarily occupied territories of Donetsk and Luhansk regions

The dissertation is devoted to the criminal enforcement model of optimization of the process of execution of criminal penalties in the temporarily occupied territories of Donetsk and Luhansk regions. In the work the general theoretical characteristic of execution of punishment in temporarily occupied territories of Donetsk and Luhansk regions is given - the concept, essence and purpose are defined. The status of penitentiary institutions after their capture by illegal armed groups is analyzed. The criminal-executive characterization of the persons who were serving their sentences in the temporarily occupied territories of Donetsk and Luhansk regions at the moment of the start of the anti-terrorist operation; persons who have been subject to a pre-trial investigation at the time the anti-terrorist operation began; persons convicted by members of illegal armed groups. The directions of solving the problems of legal regulation of execution of punishment in the temporarily occupied territories of Donetsk and Luhansk regions are determined. The state of observance of the rights of prisoners is analyzed, the ways of solving the existing problems are substantiated, the problems of legislative regulation of the execution of punishment in the temporarily occupied territories of Donetsk and Luhansk regions are highlighted, and changes to the criminal enforcement legislation are proposed.
