Bachynska O. The principle of non-discrimination and mechanisms for its realization (theoretical and legal aspects)

In this thesis, an overall scientific research of theoretical and legal aspects of the non-discrimination principle and mechanisms of its realization has been conducted. The meanings of the terms «discrimination», «protected features», «types of discrimination», «reasons for discrimination», «legitimate purpose», etc., are determined and the author gives an own definition of the principle of non-discrimination. Ukrainian and international legislation in the sphere of discrimination prevention has been analyzed, including judgments of the European Court of Human Rights, the European Court of Justice, the Constitutional Court of Ukraine and general jurisdiction courts in Ukraine. In the result of the thesis research, the main problems of implementing the non-discrimination principle in Ukraine are outlined and methods of enhancing the efficiency of the non-discrimination principle are proposed.
